Allstate’s internal memorandums leaked. The company’s number one goal when speaking with someone who was just in a car wreck was to make sure that person never spoke with a lawyer. The McKinsey slides used two pictures. Good hands if you took the early offer. Boxing gloves if you hired a lawyer or pushed back. Bloomberg reported it in In Tough Hands at Allstate. What the 40 percent line left out

The script told people a lawyer takes 40 percent and stopped there. It did not say the represented files paid more. Forty percent of a larger number can still leave you with more than the whole small check. The Montana Supreme Court, in Jacobsen v. Allstate, recited the research. Represented claims settled for 2 to 3 times more, and perhaps up to 5 times. Jacobsen signed six days after the wreck for $3,500 and 45 days of medical pay. After a lawyer, that release was pulled and the claim later resolved for about $200,000. That is one file, not a promise for yours.

A car check is not the injury claim

A check for the car is not the injury claim. Do not sign a release of all claims to get the car fixed. If the paper releases the injury claim, the later bills are yours. That is true on I-35, on Hopkins, and on the roads between San Marcos, Kyle, and Buda.
